Terms of Service & Privacy Policy

1. Acceptance of Terms

By registering an account on the Firearm Application Management System (FAMS), you agree to abide by these Terms of Service. If you do not agree with any part of these terms, you are prohibited from using this system.

2. Intellectual Property & Anti-Cloning License

2.1 Ownership: The User acknowledges that all software architecture, database structures, SAPS form generation logic, algorithms, UI designs, and underlying code (collectively, the "Intellectual Property") are the exclusive proprietary property of Quintin Horn and FAMS.

2.2 Prohibition of Reverse Engineering: The User is granted a limited, non-transferable license strictly to use the platform for its intended purpose. The User strictly agrees NOT to, nor permit any third party to:

  • Reverse engineer, decompile, disassemble, or attempt to discover the source code.
  • Copy, clone, or map the database schemas or PDF mapping methodologies.
  • Use the platform's logic or design to build a competitive product or service.

2.3 Scraping & Abuse: Any attempt to scrape data or bypass system security will result in immediate termination of the User's account and potential legal action for breach of contract and intellectual property infringement.

3. Privacy Policy & POPIA Compliance

3.1 Data Collection: We collect personally identifiable information (PII) required strictly for the generation of South African Police Service (SAPS) compliance documentation (e.g., Form 271, Form 518a, Form 517).

3.2 Protection of Personal Information Act (POPIA): In compliance with South African law, your data is encrypted and stored securely. FAMS acts as a data processor. We will never sell, rent, or distribute your personal or firearm data to external third parties for marketing purposes.

3.3 Data Retention & Deletion: You retain the right to request the deletion of your account and all associated PII at any time, subject to any legal retention requirements.

4. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials (including your MFA setup). FAMS is a software tool to assist with documentation; it does not guarantee SAPS approval of any applications, nor does it provide legal advice.

5. Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
